                    (Notice of the complaint was not ordered against respondent No.3).

 

1.          Matter has been put up before the Mediation Cell of this Commission and settlement has been placed on record. In order to identify the settlement, Ex.S1 is marked on it.

2.             It is well settled law, the settlement between the parties should be workable, except, the little bit modification, in the settlement, is legally workable. In the settlement Ex.S1, non specific time mentioned, in which check meter will be  installed by the respondent, at the cost of the complainant.

3.            Since, the parties have amicably settled the matter. So, without making any adverse, comment on the act and conduct on any of the party, as matter settled amicably, the complaint is accepted, against the respondent.

4.            Keeping in view the settlement, Ex.S1, the check meter will be installed by the respondent, within the period of 15 day from date of order and after installation of the check meter, by the respondent, at the cost of the complainant, revised bill for the disputed period of 1118 days, will be issued by the respondent, without charging any fine or penalty on the basis of six months average, from the new meter (units consumed) and the already deposited amount by the complainant will be adjusted, in the new bill and the balance, if any, shall be payable by the complainant, within the specified period of the new bill.

5.           Parties are left, to bear their own cost of litigation, itself. Certified copy of this order, be supplied, to the parties, free of costs. File be consigned to the records.
