      Complaint u/s 35 of the Consumer Protection Act, 2019

ORDER:                    

 

                Today the case is fixed for consideration on the point of admissibility.

2.             The complainant has filed the present complaint U/s 35 of the Consumer Protection Act, 2019 against the opposite party (hereinafter referred to as ‘OP’) on the averments that on 12.04.2024, the complainant moved an application U/s 76 of Indian Evidence Act, 1872 to OP for obtaining the information and documents regarding electricity connection No.WA-15-1085-W and also attached postal order of Rs.100/- with the said application but the OP has not provided the information within stipulated period. The complainant got served legal notice upon the OP with a request to provide the information but despite that no information has been given by the OP. Thus, the act of OP amounts to deficiency in service and unfair trade practice. Hence, the present complaint.

3.             Arguments on the point of admissibility heard.

4.             By way of present complaint, complainant has sought the following information from SDO (C) Sub Division-II< UHBVN Assandh, District Karnal, i.e. OP:-

i)              कनैक्शन No.WA15-1085-W जो खेवट न0.264 में कनैक्शन के लिए जो आवेदन किया था। मुझे इसकी पुरी फाईल की सत्यापित प्रति दी जाएं।

ii)                 जो आपकी अभिरक्षा में कनैक्शन न०.WA15-1085-W जिस खेवट न०. में लगाया गया है यह खेवट न०.278 है जिसकी फाईल की पुरी सत्यापित प्रति दी जाएं।

iii)                आपकी अभिरक्षा में 03.11.2022 को जो आपके द्वारा पुलिस कार्यवाही के लिए लैटर जारी किया गया था। उस लैटर पर जो कार्यवाही हुई उसकी सत्यापित प्रति दी जाऐ।

5.            The abovesaid information was sought by the complainant from the OP under Section 76 of Indian Evidence Act, 1872, and it was the OP who will decide whether the complainant was legally entitled to obtain the said information as per law or not. On perusal of the application by which the complainant sought information from the OP, it reveals that the information sought by him does not meant for personal use of the complainant. It appears that complainant has sought the said information just to harass and blackmailing the OP. If the OP had not supplied the alleged information, the complainant had remedy to file an appeal/revision/complaint before the competent authority. Inspite of availing the efficacious remedy, the complainant has filed the present complaint just to waste the precious time of this Commission.

6.             Hence, in view of the above discussion, the present complaint is devoid of any merits and same is hereby dismissed in limine. The party concerned be communicated of the order accordingly and the file be consigned to the record room after due compliance.
