Dated the 20th day of March, 2013 ORDER The complainant No.1(Amar Singh Sandhu) is not present nor any authorized agent has appeared on his behalf. So, the complaint qua complainant No.1 is dismissed for non-prosecution. Sh.Robert Sessler,Complainant No.2, has made the following statement, recorded separately:- “Due to technical defect and in view of the ratio of the case titled “U.P. Power Corporation Ltd. & ors. vs. Anis Ahmad” passed by the Hon’ble Supreme Court of India in Special Leave to Appeal (Civil) 35906/2011 (CC 20407/2011) vide order dated 12.12.2011, I do not press this complaint at this stage. It be dismissed as withdrawn. However, I reserve my right to fie a fresh complaint on the same cause of action after decision of the case mentioned above.” In view of the said statement of complainant No.2, this complaint is dismissed as withdrawn qua complainant No.2, with liberty to file a fresh complaint on the same cause of action after decision of the case, mentioned above in the statement, as per law. Certified copy of this order be communicated to the parties free of cost. After compliance file be consigned.
