ORDER

CC No.129 of 2024.

Sameer vs. SBI Life Insurance Co. Ltd.

 

Present:       Sh.Tejveer Dhingra, Adv. for complainant.

                    None for opponents.

                                     

                   Complaint presented before the registry of this Commission on 5.4.2024 and put up before this Commission on today itself. It is hereby ordered to be registered against the registration number already allotted by the registry of this Commission.              

                   Complainant attached documents Ex.C1 to Ex.C9 with the complaint.

                   Heard.

                  The complainant being nominee of insured raised claim as per insurance policy Ex.C.4, during the validity period of insurance policy. The insured expired on 15.2.2021, but the claim of the complainant was not settled and ultimately, the complainant gave legal notice dated 1.3.2024 Ex.C.6 to the opponents, who vide reply dated 18.3.2024 Ex.C.8 required documents mentioned in para No.5 of reply of legal notice dated 18.3.2024 and the complainant has not replied to the letter dated 18.3.2024 Ex.C.8 of the opponent.  Issuance of letter dated 18.3.2024 Ex.C.8 by the opponent, shows claim of the complainant has not been decided, either way by the opponent, so complaint of the complainant is pre-mature.  In order to maintain balance, if appropriate directions are given to both the parties, it will suffice the purpose and ends of justice will meet.

                Without making any adverse comment on the act and conduct of the opponent, the complaint is rejected, it being pre-mature and the complainant is directed to submit the documents mentioned in letter dated 18.3.2024 Ex.C.8 with the opponent No.1 within 15 days from today, if already not submitted and thereafter, the opponent No.1 shall decide the claim of the complainant, on the basis of insurance policy Ex.C.3 within the period of one month from the date of receipt of documents from the complainant, if already not received in either way by passing speaking order. Thereafter, if within the stipulated period as ordered here-in-before, the claim of the complainant is not settled or complainant is not satisfied with the settlement, then, he shall be at liberty to file a fresh complaint, before this Commission, disclosing the particulars of the present complaint and its fate and will attach the copy of this order with the fresh complaint, if any filed. At this stage, no notice is required to be issued to the opponent, providing opportunity of being heard as no adverse order is passed against them.  Certified copy of this order be supplied to the complainant free of costs. However, it is made clear the complainant will transmit the copy of this order to the opponent No.1, either by hand or through registered post. Original documents Ex.C.6, Ex.C.7 and Ex.C.8 are hereby ordered to be returned to the complainant through his counsel against proper receipt. File be consigned to the records.
