The Ld. Counsel for the complainant is present.

          Today is fixed for admission hearing. The Ld. Counsel for the complainant submits that the complainant is not interested to proceed with his case in this manner as due to inadvertence the case was filed in her name instead of her daughter.

          The complainant has prayed for liberty to file afresh. According to the complainant if this prayer is not allowed she will suffer irreparable loss and injury and prayer is made by the complainant for allowing this submission.

          Upon hearing from the Ld. Advocate for the complainant we are of the view that admittedly the complaint has been filed wrongly as the service was hired not by this complainant rather it was hired by her daughter but her daughter has not been party in this complaint. As the complainant is inclined to withdraw the complaint, we have no objection.

Hence the complaint no- 261/2018 is hereby dismissed on the ground of non-prosecution without being admitted. However liberty be given to the complainant to file afresh before the appropriate Forum/Court/Commissioner, if not barred otherwise.

Let plain copy of this order be given to the parties free of cost as per the CPR, 2005.
