ORDER

 

1.         This order will dispose of the application moved by SBI Life Insurance Co. Ltd. praying therein that it be permitted to deposit the Demand Draft No.103739 dated 11.7.2012 for a sum of Rs.20,638/- in the account of this Forum.

2.         It has been pleaded that complaint filed by Mr.Avtar Singh & ors. was allowed by this Forum vide order dated 23.11.2011. The SBI Life Insurance Co. Ltd. preferred the appeal against this order and the Hon’ble State Commission, U.T. Chandigarh vide its order dated 1.5.2012 disposed of the appeal and directed the Insurance Company to refund a sum of Rs.15,000/- paid as premium, by Dharam Singh (deceased) with interest @ 10% p.a. from 15.9.2008. It has been further pleaded by SBI Life Insurance Co. Ltd.  that in compliance of the said order, the applicant sent a cheque of Rs.20,638/- to Mrs.Malkit Kaur alongwith covering letter dated 12.6.2011. However, the said letter was received back undelivered by the applicant. In these circumstances, according to the applicant, it wants to deposit the said amount by way of demand draft so that it can be disbursed to the complainant.

3.         In view the facts mentioned in the application, the applicant(SBI Life Insurance Co. Ltd.) is permitted to deposit the demand draft of Rs.20,638/- with this Forum. The above said amount be deposited in the shape of FDR for a period of one year having maximum interest in the account of the District Forum. Necessary intimation, in this regard, be sent to the complainants.

4.         Copy of this order be placed on record of the Execution Petition file, if any.

5.         Certified copy of this order be communicated to the parties free of cost. After compliance file be consigned.
