File taken up today on an application moved by ld. Counsel for the complainant. Ld. Counsel for the opposite party made a statement that their full and final settlement has been effected with the complainant for Rs.1,00,000/- only(Rs. One lakh only) and he will make the payment within 60 days.
Ld. counsel for the complainant made a statement that he agrees with the above statement. It is further stated that complainant has lost the original payment receipt of bill of Jai Hanuman Medicos & Surgical amounting to Rs.25,255/- and receipt of final Hospital bill of S.K.M. Hospital bearing bill no.5257 dated 30.5.2016 amounting to Rs.50,400/-. Neither there is any government employee in the family of complainant nor the reimbursement of these bills has been taken. In view of the above statement, he has no objection to decide the case accordingly.
In view of the statements made above by both parties, present complaint is hereby disposed of with direction to the opposite party to pay the alleged amount of Rs.1,00,000/- only(Rs. One lakh only) to the complainant within 60 days, failing which opposite party shall be liable pay interest @ 9% per annum from today i.e.28.7.2021 till its realization. Parties shall be bound by their respective statements. Copy of this order be supplied to the parties free of cost.
File be consigned to the record after due compliance.
