DH/complainant appeared in person and also suffered his separate statement to the effect that he has received a cheque bearing no.168782 dated 28.04.2022 amounting to Rs.67173/-from this Commission as payment of awarded amount. He undertakes that if the order of this Commission is reversed/set aside by the Hon’ble State Commission, Panchkula, and he will be directed to pay the aforesaid amount along with interest, if any, in that eventuality, he will be bound to pay the same. Further, if he fails to deposit the same, in that eventuality, the aforesaid amount will be recovered from his property i.e. agriculture land situated at village Patanpuri, Tehsil Nighdu, District Karnal. He placed on record copy of security bond alongwith copy of Jamabandi for the year 2016-2017. The value of the said land is more than Rs.3,00,000/-(Rs. three lakhs) and the said property is free from all encumbrances. He will not sell the said property till the final disposal of the appeal, pending before the Hon’ble State Commission, Panchkula, pertaining to the present application. He also placed on record copy of his Aadhar card.
He further stated that he has received the awarded amount as full and final payment. So, he does not want to pursue the present execution petition further and withdraws the same being fully satisfied.
Copy of cheque has been placed on record.
In view of statement of DH, the present execution petition is dismissed as withdrawn being fully satisfied. Parties concerned be communicated of the order accordingly and file be consigned to the record room with the observation that as and when any order will be received from the Hon’ble State Commission, it will be restored and will be proceeded further in accordance with law. Concerned Clerk/Assistant of this Commission is directed to send intimation of this order to the concerned Tehsildar with the direction to incorporate the entry in the property placed by the DH/complainant in the revenue record. Photocopy of the Jamabandi be also sent alongwith this order to the concerned Tehsildar.
