Final Order / Judgement

During the course of arguments, it has been pointed out by learned counsel for OPs No.1 to 3 that the complainant has not lodged claim with the OPs No.1 to 3 regarding the damage to the builing under the policy No.0000000002598068.  Counsel for complainant as well as complainant-Dharampal who are present in this Forum have stated that they are ready to file proper claim alongwith requisite documents regarding damage occurred to the building under the poicy in question to the OP No.2 within 30 days from the date of receipt of the copy of this order and the counsel for Ops No.1 to 3 stated that they are ready to decide the claim case of the complainant regarding damage to the building under the policy in question.  Resultently, the present complaint is disposed of with direction to the complainant to file proper claim on claim form alongwith requite documents with OP No.2 withing 30 days and afterthat OPs No.1  to 3 are directed to decide the claim case of the complainant under policy in question regarding damage to the building within two months from the date of receipt of claim alongwith requisite documents from the complainant.  However, the claim amount shall be first charge of the bank i.e. Op No.4 regarding outstanding loan amount.

          Original documents, if any, filed by the parties be returned to the parties, under proper receipt, as per rules.

          Keeping the view the peculiar circumstances of the case, parties are left  to bear own costs.  File be indexed and consigned to record room
