08-08-2023 Present : Sh.Sukhpal Singh, counsel for the complainant

 

This order shall dispose of present complaint after affording preliminary hearing to the counsel for the complainant.

During preliminary hearing, counsel for the complainant has argued that complainant lodged insurance claim with the opposite parties and furnished requisite formalities i.e. copy of insurance certificate, death certificate of Mandeep Singh and DDR regarding accidental death etc., and even legal notice was also served on the opposite parties, but the opposite parties have failed to settle the claim till date. That Mandeep Singh, son of the complainant died on 27-4-2021 in the motor vehicle accident and a DDR No. 15 dated 11-5-2021 has been got lodged regarding the said accident. The complainant suffered from grave mental tension, agony, harassment, humiliation and also suffered financial loss.

We have heard learned counsel for the complainant and gone through the record.

A perusal of file shows that complainant lodged insurance claim and submitted above said documents with the opposite parties and thereafter sent legal notice on 13-6-2023 but the opposite parties have not responded till filing of complaint nor settled the claim. This Commission is of the view that complaint is pre-mature at this stage. As such, without going into merits of the case, opposite parties are directed to settle the claim of the complainant within 45 days from the date of receipt of copy of this order. As such, complaint stands disposed off.

Copy of order be issued to complainant and opposite parties free of cost and file be consigned to record room.
