Complainant is present in person.

Today is fixed for admission hearing.

Heard the Complainant in person, who submits that he had applied for SBI Credit Card on 21.03.2005 in his name through the local representative of SBI Credit Card Limited. He never received any Credit Card from the OP. According to him on several dates he received telephone calls from Mumbai, Delhi and Kolkata with a threatening of immediate payment of Rs.40,000/- to the OP. The amount of Rs.40,000/- was claimed as value of goods purchased by him though the Complainant has not received any SBI Credit Card. The Complainant had reported the matter to different authorities of SBI Credit Card Division including the Officer-in-Charge of Mahestala Police Station. The matter was also published in Bengali Daily Newspaper ‘Bartaman Patrika’ But, unfortunately the matter remain unresolved. Ultimately, on 18.06.2018, the Complainant received a demand notice directing to pay Rs.3,58,872.68 to the OP. Hence he has filed the instant complaint.

            Perused the complaint petition coupled with its annexures thereto. Admittedly, the Complainant had applied for the SBI Credit Card on 21.03.2005 in his name through local representative of OP. The Complainant alleged that he has not received any SBI Credit Card in his name till today. As such, he prays for admission of complaint petition.

            We find from the paragraph-1 of the complaint petition that the Complainant  has not received any SBI Credit Card from the OP in spite of his application.

            As such, the Complainant is not a consumer and is not covered u/s 2(1) (d) of CP Act, 1986. Therefore, the Complainant has no locus standi to claim as consumer. Accordingly, the complaint petition is not admitted.
