Respondent has been duly served by Regd. AD post, but there is no appearance on behalf of respondent. As nobody is appearing on behalf of respondent since morning, respondent is proceeded ex parte. The present case pertains to theft of electricity. In view of the order passed by Honle Supreme Court in .P. Power Corporation Ltd. and others Vs. Anis Ahmed(Civil Appeal No.5466 of 2012 decided on 1.7.2013), the complaint filed in the present case before the District Forum under the Consumer Protection Act, 1986, is not maintainable. Accordingly, present revision petition filed by the petitioner/opposite party stands allowed and complaint filed before the District Forum stands dismissed. However, liberty is granted to the respondent to seek appropriate remedy available to him before the appropriate Forum. With these observations, present petition stands disposed of. Dasti to both parties.
