1.    Alleging deficiency of service and unfair trade practice, the complainant has filed this case against the O.Ps for refund of Rs.1498.50 alongwith compensation and litigation cost.

The brief fact of the case of the complainant is that he had purchased a Samsung Mobile set on 7 Pro for a consideration of Rs.9990/- which has been deducted from the Account of the friend of the complainant namely Bikash Chanda Barik through Debit card No.6079260202470616.The O.P.No.1 delivered the aforesaid mobile to the complainant and issued a Retail/Tax Invoice/Cash Memorandum in favour of the complainant. As per the terms and condition the O.P. will refund cash back 15% on amount of Rs.9990/-.So the complainant is entitled to get Rs.1498.50 from the O.P.s.After sending copy of H.DFC Bank pass book of the complainant through e.mail the O.Ps did not refunded Rs.1498.50.After several approaches  they did not listen which forced the complainant to file this case against the O.P.s
3. Being noticed, the O.P.No.2 appeared in this case and filed his counter. The O.P.No.1 did not appear in this case as such he was set ex-parte.
4. In the meantime, the O.P.No.2 deposited Rs.1498.50 in favor of the complainant’s friend account. As such we disposed the case of the complainant against the O.P. without cost.
