            Mrs. S.K. Pounikar, advocate is present for the appellant. Mr. Mishrikotkar, advocate is present for the respondent.  The learned advocate for the appellant has filed an application  for grant of permission to withdraw the power for the appellant  along with  copy of notice to  appellant  sent by the learned advocate for the appellant on 09/02/2022.  It was received by the appellant on 15/02/2022 as per track report  enclosed  along with application.  In view of this  application  and submission  made by the learned advocate for the appellant, the learned advocate for the appellant  is hereby discharged  in this  appeal.  Further  as per record, the appellant  was absent  during the previous  hearings.  As per  submission of the learned advocate for the respondent the  appellant  has never complied  with the order passed by the learned Additional District Consumer Forum, Nagpur as well as  not appeared  before this Commission during the hearing  of this appeal. As per order passed by  this  Commission on 25/04/2022 last opportunity  was granted  to the appellant  for hearing  on admission  of this appeal.  Appellant  failed  to remain present  as well as learned advocate for the appellant  has withdrawn the power on behalf of the appellant. As per on previous order since he failed to remain  present before this Commission  today, the appeal is  hereby dismissed.
