ORDER

Alongwith the appeal, an application for condonation of delay of 22 days as per the applicant/appellant, in filing the appeal, has been filed.

                   Heard.

                   For the reasons stated in the application, which is supported by a duly sworn affidavit and finding sufficient cause, the delay aforesaid is condoned.

                   The application is disposed of accordingly.

                   On 04.12.2018, following order was passed by this Commission:-

            “As per office report, record of the District Forum has been received.

            Alongwith the appeal, an application for condonation of delay of 22 days, in filing the appeal, has been filed.

Counsel for the applicant/appellant is trying to convince us on merits, which he failed after addressing long arguments. Faced with the situation, at that stage, he stated that compensation of Rs.25,000/- awarded by the Forum is on the higher side. Limited to that extent, notice of motion be issued to the respondent/complainant for 17.12.2018. 

Counsel for the applicant/appellant states that he will bring the demand draft for an amount of Rs.1,70,000/- on the next date of hearing.

Liberty is granted to the applicant/appellant to serve the respondent/complainant through Counsel, who represented her before the Forum.

                   In response to above order, Sh. Jaswinder Singh Mann, Advocate for the appellant has handed over three cheques bearing Nos.267246, 267247 & 267348 all dated 14.12.2018 in the sum of Rs.49,999/-, Rs.1,00,253/- & Rs.19,748/- respectively, to Sh. Devinder Kumar, Advocate, Counsel for the respondent/complainant against receipt. Photocopies of the said demand drafts have been retained on file.

                   We have gone through the contents of appeal, complaint and also heard Counsel for the parties.

                   We are of the opinion that the compensation awarded by the Forum is on the higher side and, accordingly, it is reduced from Rs.25,000/- to Rs.10,000/-.

                   In view of above, on account of amount paid, the entire liability of the appellant stands discharged. The appeal stands disposed of accordingly.

                   It is further ordered that the amount of Rs.25,000/- lying deposited with this Commission in the shape of FDR be released in favour of the appellant ‘Aegon Life Insurance Company Limited’, as prayed for, alongwith interest, which may have accrued on the Fixed Deposit Receipt.        

                   Accountant of this Commission should ensure the correctness of the particulars of the cheque to be prepared in favour of the party concerned, before issuing the same, by tallying the particulars from the application.         

                   Needful be done within seven working days from today.

                   Certified copy of the order be supplied to the parties free of charge.
