JUSTICE SHRI.K.R.UDAYABHANU:  PRESIDENT

 

The appellants are the opposite parties/Co-operative Bank in CC.102/08 in the file of CDRF, Kollam.  The appellants are under orders to pay a sum of Rs.30,000/- as compensation and Rs.1500/- towards cost to the complainant.

2. The matter relates to the missing of the title deed of the complainant from the custody of the bank.   The original title deed was deposited for availing a loan of Rs.40,000/-.  The loan amount was paid but the document was not returned.  It was in the above circumstances that the Forum ordered to pay the above amount as compensation as the loss of title deed would create so many problems in case of the disposal of the property so far as the complainant is concerned.

3. We find that practically there was no defence for the appellant/opposite party.  It is for the bank to see that an original document especially with respect to the property is kept safely. The bank ought to have kept the title deeds in safe custody.  There is also no evidence to show that any action has been taken against the concerned officials.  In the circumstances we find that no interference in the order of the Forum is called for.

  The appeal is dismissed in-limine.

  The office will forward a copy of this order to the Forum urgently.
