This complaint is preferred by the complainant seeking direction against the opposite party to pay a compensation of Rs. 5,000/- since the opposite party purposefully supplied only a very small quantity of green peas curry.
2. We have heard the complainant who appeared in person and gone through the averments of the complainant in the complaint. It is to be noted that the prices are fixed at the whims and fancies of the hotel owners with absolutely no regulatory mechanism. Consumers can not even demand a minimum quantity of food stuff to be served. The only right they can assert is public display of a price list at a conspicuous place of the hotel or restaurant. The Hon’ble National Consumer Disputes Redressal
Commission in Nitin Mittal Vs. Pind Balluchi Restauarant IV (2012 CPJ 224 (NC). It is now well established that consumer courts on the issue of pricing do not interfere in such matter as it is the discretion of the concerned restaurant to change the price of the items as they wish.
3. In view of the above we are only to dismiss this complaint in limine. Ordered accordingly.
