Counsel for the petitioner states that the directions given in the previous order subject to which notice was issued, could not be complied with by the petitioner Department though he has sent a communication on 1.06.2012. Subject to additional cost of Rs.5,000/- payable to the respondent last opportunity is granted to comply the directions. At this stage, counsel for the petitioner states that he is not interested in prosecuting the present petition. The petition as such is dismissed as withdrawn. However, cost imposed shall be paid to the respondent within four weeks failing which it would be open for the respondent to execute the order. It is made clear that if in the reckoning of the higher authorities of the petitioner, the cost imposed should be recovered from the salary of any officer responsible for the negligence / dereliction of duty, he may take necessary action in that behalf.
