Final Order / Judgement

Today is fixed for hearing of this M.A. case which has been filed by O.p. no.4 for expunging their name from the C.C. case No.256/2023. This matter has been contested by the O.p. who is the complainant of the above noted complaint case.

Heard both sides. Considered submission.

After going through the materials of the case record this District Commission finds that the complainant (who is the O.p. of this M.A. case) purchased the vehicle from O.p. no.4 by way of making payment and O.p. no.4 has also arranged the Insurance Company for providing insurance and O.p. no.4 has also issued Tax Invoice.

The O.p. no.4 cannot escape from the product liability as per Section 2(34) and from the liability of Product Seller as per Section 2(37) of the Consumer Protection Act, 2019.

Considering all the above noted factors the prayer of the applicant for expunging their name is rejected on contest.

In the light of the observation made above this M.A. case is disposed of. No order is passed as to cost.
