JUDGMENT JUSTICE K.R.UDAYABHANU : PRESIDENT The appellant is the 1st opposite party in CC.28/2008 in the file of CDRF, Kasargod. It is the grievance of the appellant that the matter has been decided ex parte. 2. We find from the proceedings of the Forum that the notice was refused by the appellant. The appellant has explained that one of the staff members of the opposite party, out of ignorance refused the notice. 3. In the circumstance and in view of the fact that the order is not a considered one appeal is allowed on condition that the appellant pay a sum of Rs.1000/- to the complainant or remit the same before the Forum which can be withdrawn by the complainant within one month from the date of receipt of this order before the Forum. The Forum will issue notice to the complainant and the 2nd opposite party and dispose of the matter on merits. Both sides should be permitted to file version as well as to adduce evidence. The matter will stands posted before the Forum on 18.10.08. Office is directed to despatch the order to the Forum urgently.
