Sh. Nitin Kumar Garg, learned counsel for the appellant and Sh. Umesh Arora, learned counsel for respondent    No. 2, are present.  None is present on behalf of respondent No. 1, although service of notice upon respondent No. 1 has been held to be sufficient vide order dated 20.09.2022.

A Compromise Deed has been filed on behalf of the appellant and respondent No. 2, stating therein that the compromise has taken place between them, hence the appeal should be decided in terms of compromise. 

The Compromise Deed has been verified by learned counsel for the appellant and respondent No. 2.

Learned counsel for the appellant and respondent No. 2 state that this appeal may be decided in terms of the compromise.

Accordingly, the appeal is decided in terms of the compromise, which shall form part of the order.
