CC No.387 of 2022.

Sunita vs. Sarva Haryana Gramin Bank.

 

Present:           None for complainant.

 

                   This complaint has been called several time since morning, but the complainant failed to appear before this Commission, either in person or through any Advocate up to 3.00P.M.  It is pertinent to mention on the first date of hearing i.e. 19.9.2022, neither the complainant was present nor her counsel, whereas the complainant or his counsel ought to have present and document Ex.C.2 placed on record is not legible, this was also observed on 19.9.2022, thereafter proceedings were adjourned to 28.9.2022 and again on 28.9.2022, the complainant or her counsel failed to appear, rather, one lady Advocate Ms. Geeta appeared, but the compliance of order dated 19.9.2022 has not been done.

                   The complainant relying upon the document Ex.C.2, contents of the same are not legible, being un-legible it amounts to patent defect in the complaint. Without making any comments on the merits of the case, the complaint is dismissed, being suffering from patent defect.  However, the complainant shall be at liberty to file a fresh complaint, after removing the patent defect as referred here-in-before and in the fresh complaint the complainant will disclose the particulars of the present complaint and its fate. File be consigned to the records.
