            Shri Parag Kale, learned counsel for the appellant.

              Counsel for parties submit that the matter is covered by the order passed by this Commission in First Appeal No. 393/2011 (Suresh Vs ICICI Lombard & Anr) on 27.02.2016.

              In view of the aforesaid and having regard to the fact that the Nodal Officer has not forwarded the claim of the complainant to the Insurance company and also the fact that there is no document indicating therein the claim was forwarded by the Nodal Officer to Insurance Company, it is clear that the question involved in this matter is squarely covered by the order dated 27.02.2016 passed in First Appeal No.393/2011.

            Accordingly for the reasons stated in the order dated 27.02.2016 in First Appeal No. 393/2011 (Suresh Vs ICICI Lombard & Anr) the appeal deserves to be and is hereby dismissed.
