ORDER

Shri Parag Kale, counsel for appellant.

With the consent of counsel for the parties, this appeal is heard and disposed of.

It has been pointed out by the parties that the complaint filed before the Forum has been dismissed only on the ground of it being barred by limitation.

Since the question of limitation in similar cases has been considered and decided by this Commission on 12.3.2015 in Appeal No. 1067/10 Reenabai vs. ICICI Lombard General Insurance Co.  and another, the impugned order passed by the Forum is set aside and the case is remanded back to the Forum for disposal according to law. 

 

The question of limitation shall also remain open and shall be decided  on the facts of the case, by the Forum in the light of ratio of the aforesaid decision.

The appeal stands disposed of accordingly.
