Today is fixed for ex-parte hearing. Notice was served upon the OP. But the OP has not turned up and has not filed W/V. The Complainant is found absent on call. The record shows that no step was taken by the Complainant on 12.08.22, 07.12.22, 15.02.23, 25.05.23, 31.07.23, 20.09.23, 10.01.24, 24.04.24 and today i.e. 02.05.24. The Complainant filed the case praying for passing an order directing the OP to pay Rs. 1,24,000/- along with interest and to pay Rs. 50,000/- for unfair trade practices and Rs. 15,000/- for litigation cost. We peruse the materials on record. Considering the facts and circumstances of the case we find that the that the Complainant is not at all interested in the instant case as the Complainant took no steps from 12.08.22 to till now. The Complainant has not filed evidence in support of his case. Such being the position, we are of the view that the instant complaint is liable to be dismissed. In the result, the Consumer case fails. Fees paid are correct. Hence, it is Ordered that the complaint Case No. CC/38/2021 be and the same is dismissed on merit against the OP. Let plain copy of this order be supplied free of cost, to each of the parties / Ld. Advocate/Agent on record, by hand /by post under proper acknowledgment as per rules, for information and necessary action.
