The complainant is present in person as well as through his ld. Advocate by filing hazira. Today is fixed for S/R & appearance of the Ops.
One unserved envelop in respect of OP-2 has returned with the postal remark “refused”. As refusal tantamount to good service, hence the service is completed. In respect of service of notice upon the OP-1 one postal track record is field by the ld. Counsel for the complainant, from where it is evident that the OP-1 has also received the notice but is absent on call.
However, today the complainant appearing personally as well as through his ld. Advocate files a petition praying for dispose of the present case on the ground on the ground of non-prosecution as his grievance has been redressed out of Forum amicably and for this reason he is not inclined to proceed with this complaint, it is further stated in the petition that during pendency of this complaint, the Ops have replaced the Television set to the complainant.
After going through the said petition we are of the view that as the complainant himself is not inclined to proceed with this complaint as his grievance is already been redressed by the Ops out of Forum amicably, hence the complaint being No. 133/2016 be disposed of as non-prosecution. Hence, it is

that the Consumer Complaint being No. 133/2016 is hereby dismissed for non-prosecution. There is no order as to costs.
Let plain copies of this order be supplied to the parties free of cost as per provisions of Consumer protection Regulations, 2005.
