Today is fixed for showing cause by the complainant as to why the present complaint shall not be dismissed for non-prosecution.

The OP No.1 files hazira through Ld. Advocate. No step is taken by the complainant. On repeated calls, none appears on behalf of the complainant. Even no show cause has been filed by the complainant.

Heard the Ld. Advocate for the OP No.1.

Perused the case record. It appears that there was in the stage of ex parte hearing of the case against OP No. 2 and as no step was taken by the complainant show cause was done. The complainant also did not take any step in this case since long. The case is not in the stage of evidence. Therefore, it can be said that the complainant is not willing to proceed with the case further. As there is no evidence on record on behalf of the complainant this is a case of no evidence.

Under the above facts and circumstances, we have no alternative but to dismiss the case.

Hence, it is

Ordered

that this case be and the same is dismissed for non-prosecution.
