This appeal is directed against 06.06.2014 in Case No. 712013 passed by the Ld. District Consumer Disputes Redressal Forum, Uttar Dinajpur, (for short, District Forum). By the impugned order, the Ld. District Forum has allowed the case. Being aggrieved by and dissatisfied with the same , the OP thereof has preferred this appeal.
The case of the complainant is that he applied for electric connection in respect of his two shallow tube wells to the OP on 07.08.2011 and it was inspected on 31.10.2011 and 22.02.2012 and quotation was raised on 26.01.2012 and 27.07.2012 and quotation money of Rs. 6,985/- and Rs.6,899/- was deposited on 02.02.2012 and 19.10.2012. But, after that 18 months crossed no electric connection to the shallow tube wells was done, for which he made several representations stating difficulty in cultivation for want of said electric connection. He also made RTI query on 24.07.2012 which was replied on 22.08.21012 stating that local people objected to it. But, on his query, no such objection was produced. As the problem was not remedied, the case.
On the other hand, the case of the OP is that there was obstruction from the villagers of Bhebri for which the work would not be carried out. But, they completed said work before the Boro season of 2013 with the help of police. But, the said connection was disconnected by the villagers of Bherbri village. Accordingly, there was no deficiency in service and negligency on the part of the OP to effect the service connection to the Complainant.
Decision with reasons
Ld. Advocate for the Appellant has submitted that two shallow tube wells are involved in the matter. The attempt to give service connection failed for which the OP is not involved.
Respondent has submitted that there is been no resistance by the local people. It is a flimsy ground on the part of t he Appellant.
The Ld. District Forum has considered the whole spectrum of the case and found deficiency in the service on the part of the OP. There has been much persuasion on the part of the Complainant to get his desired connection for his two shallow tube wells for cultivation in his field. Thus, the impugned order making an award directing the OP to supply electric connection for two shallow tube wells of the Complainant is a befitting one and also the litigation cost of Rs.2,000/-. But, the compensatory amount of Rs.30,000/- is reduced to Rs.5,000/-. The impugned order is thus modified to the extent that the compensation amount of Rs. 30,000/- stands at Rs.5,000/-. Other part of the ordering portion will stand. Appeal is allowed in part.
