Today the present Execution Application is fixed for tendering name and address of the owner/proprietor/authorized person of JD subject to last opportunity with a rider in case of non-compliance present execution shall be dismissed for want of prosecution but today neither DH nor JD has appeared in-spite of repeated calls. On perusal of case file, it has come into notice of the Commission that on the previous date of hearing i.e. 12.09.2022  DH also failed to submit the whereabouts of JD though in the interest of justice, one last opportunity was afforded to complainant for the same but of no avail.  It is 12.00 P.M.  Let, case file be again put up after lunch break.

Present:           None.

                        Case file taken up but this time also neither DH nor JD appeared before the Commission.  Case called several times. It is 3.50 P.M. Waited sufficiently. Further wait seems not to be justified. Accordingly, we have no option except to dismiss the present execution application for want of prosecution.  Hence, the present Execution Application is hereby dismissed in default for want of prosecution. Certified copies of the order be sent to the parties concerned, as per rules. File after due compliance be consigned to the record room.
