1. Complainant has filed the present complaint against education Institute i.e. Sanskar International School on the ground that complainant got admitted his children in the OP school and OP school charged Rs.70,000/- as fee for three months vide two separate receipts dated 06.04.2015 and since then the children of the complainant attended the classes for 15-20 days only. The complainant and his children were not satisfied with the atmosphere of the teaching staff of the school, so his children did not attend the school thereafter. Therefore, complainant prayed for refund of the fee alongwith compensation and litigation expenses.
2. We have heard the complainant & his counsel and have minutely gone through the record. It has been held by Hon’ble Supreme Court of India in the cases; P.T. Koshy and another Vs Ellen Charitable Trust and others 2012 (3) CPC 615, that; In view of the judgment of this court in Maharishi Dayanad University Vs. Surjeet Kaur reported in 2010 (11) SCC 159 = 2010 (2) CPC 696 SC, wherein this court placed reliance upon all earlier judgments, has categorically held that education is not a commodity. Educational Institution are not providing any kind of service, therefore, in matter of admission, fee etc, there cannot be a question of deficiency of service. Such matter cannot be entertained by the Consumer Forum under the Consumer Protection Act, 1986”.
3. Therefore, this complaint is not maintainable as the complainant is not consumer qua the OP. As such, this complaint is disposed of with order that this complaint be returned to complainant, under proper receipt with liberty to file the same before the appropriate authority. Papers be consigned to the Record Room
