This appeal was initially taken up for admission hearing at 11.00 a.m.  At that time none had appeared for appellant.  Therefore it was kept back.  Presently it is taken up for hearing at 1.05 p.m. at this time none has appeared for appellant.  Adv.Shri.Sunil Thite appeared for respondent.  Perusal of daily proceedings shows that none appeared for appellant on 22.11.2011, 2.4.2012, 21.6.2012 & 14.8.2012.  Even on the last date cost of Rs.500/- was saddled on the appellant and it is also not paid by the appellant.  We are thus satisfied that appellant is not interested in pursuing the appeal. Appeal is therefore dismissed in default.
