12.03.2018               appellant files written notes of argument. Heard the learned counsel for the appellant. No one appears for the respondent. We have considered the case of the parties as per the complaint as also perused the materials on record as well as the impugned order.

                     The controversy is with respect to the quantum of the retrial dues. The appellant submits that as per the direction of the Hon’ble High Court the Accountant General, Bihar Patna had written a letter to the Treasury Officer Sasaram to pay the amount as mentioned in vide memo no. 243 dated 08.05.2013 vide annexure 3. The appellant submits as per the direction amount has been paid to the complainant in his bank account on 31.01.2014. This apart the disputed claim with regard to the retrial due is not “consumer” ‘disputed’. We have considered the aforesaid submissions and the documents as also the impugned order as mentioned above. We are in agreement of the submissions of the appellant. The District Forum did not consider the matter in correct perspective as per law. The impugned order is thus set aside.

                 In the result, the appeal stands allowed.
