Sh. M.K. Kohli, learned counsel for the appellants is present.  Respondent – complainant Sh. Sanjeev Narang is present in person, who has been identified by Sh. D.K Sharma, Advocate.

This appeal has been filed against the order dated 16.07.2009 passed by the District Forum, Haridwar in consumer complaint No. 89 of 2007; Sh. Sanjeev Narang Vs. New Age Hotels and Resorts Limited and another.

Both the parties have entered into compromise.  A joint application for compromise has been filed before this Commission, wherein it has been agreed that the appeal be decided in terms of compromise.  The respondent has accepted the amount of Rs. 60,000/- in full and final settlement of his claim.  The demand draft of the said amount is given by the appellants to the respondent before us.  Therefore, the impugned order dated 16.07.2009 passed by the District Forum is modified and the appeal is decided in terms of compromise.  The compromise application shall form part of the order.

The statutory amount of Rs. 22,860/- deposited by the appellants at the time of filing the appeal, be released in their favour.
