ORDER

Complainant/Petitioner on attaining the age of superannuation retired on 28th February, 2003 from M/s Bharat Cooking Coal Ltd.  The Regional Commission, Coal Mines Provident Fund, Dhanbad released his arrears of pension amounting to Rs.1,99,248/- and directed the Respondent/Bank to send the said amount through cheques for payment to the Petitioner’s/Complainant’s account in the State Bank of India.  Grievance of the Petitioner/complainant is that though the remittance from the Regional Commissioner, Coal Mines Provident Fund was received by the Respondent/Bank on 09.08.2005, but no steps were taken by the Respondent for crediting the said amount in the account of Petitioner in the State Bank of India.  Being aggrieved, Petitioner/complainant filed a complaint before the District Forum.  District Forum allowed the complaint and directed the Respondent to credit the amount of Rs.1,99,248/- in the account of the Petitioner/complainant along with interest @ 9% from 09.09.2005 to 12.12.2005.  The Respondent/Bank was also directed to pay Rs.50,000/- to the Petitioner/complainant as compensation.  Aggrieved by the order of the District Forum, Respondent/Bank filed an appeal before the State Commission.  The State Commission partly allowed the appeal setting aside the direction for payment of Rs.50,000/- as compensation, rest of the order of the District Forum was upheld. 

Petitioner/Complainant being aggrieved has filed the present revision petition.  Because of the fault of the Respondent/Bank, Petitioner/complainant had to run from pillar to post to get back his legitimate dues.  Although, the foras below had granted interest but Petitioner/complainant has spent some money on litigation as well. 

Keeping all these facts into consideration, we partly allow the revision petition and direct the Respondent/Bank to pay Rs.25,000/- towards compensation to the Petitioner/complainant.  Respondent is directed to pay the sum of Rs.25,000/- within four weeks failing which the amount shall carry interest @ 9% w.e.f the date of the passing of the order by the District Forum.
