Case called out.  None is present on behalf of the appellant.  Learned counsel for the respondent is present.

This Commission vide order dated 19.03.2015 observed that the appellant has not been appearing before the Commission for the last several dates.  Again this Commission on 19.05.2015 passed an order that in case if the appellant does not appear on the next date fixed, then the matter shall be decided in accordance with law.

This appeal has been preferred with a delay of one year eight months 26 days before this Commission.

However, after filing this appeal before this Commission, none has been appearing on behalf of the appellant for the last several dates, either to press the delay condonation application/affidavit or the appeal on merits itself.

We, therefore, do not have any other option except to dismiss the delay condonation application in default of the appellant.

                        Accordingly, the delay condonation application is dismissed, consequently the appeal also stands dismissed in default.
