Heard counsel for the parties. 

Limited notice was issued in this matter relating to payment of interest.  According to the counsel for the petitioner, interest should have been granted from February, 1998 and not from April 1996, as awarded by the fora below.  Admittedly, the vehicle met with an accident in April 1996 and the survey report was ready in August, 1996.  In view of this, we are of the opinion that the interest should have been paid to the complainant after three months of the survey report, i.e., to say from 1.12.1996.  In view of this, the revision is partly allowed and interest payable to the complainant w.e.f. 1.12.1996  instead of April 1996.  The orders of the fora below are modified to that extent and the revision, is allowed to that extent, with no order as to costs.
