With the consent of both counsel for the parties, the matter was finally heard. There was delay of only 7 days in filing the appeal and the grounds given were that the Appellant Company has engaged a new lawyer and the record of the company was not immediately traceable. Taking into account the extent of delay and the grounds stated in the application for condonation of delay, we are of the view that the delay in question should be condoned. In view of this, the order of the State Commission is set aside and the State Commission shall hear the matter on merits and will endeavour to dispose of the matter at the earliest, preferably within three months of the receipt of the order. The revision is allowed in aforesaid terms and the matter is remanded to the State Commission as aforesaid with no order as to costs. Dasti copy of this order be given to both the parties.
