Vide order dated July 08th, 2011 complaint titled ‘Kuldeep Kumar versus The Sangam Co-operative Building Society Limited and Another’ was dismissed in default by District Consumer Disputes Redressal Forum, (for short ‘District Forum’), Yamuna Nagar.

2.      Against the said order, Kuldeep Kumar-complainant filed application to set aside the order before the District Forum but the same was also dismissed vide order dated March 30th, 2012.

3.      Aggrieved of the orders of the District Forum, complainant filed appeal before this Commission, which was dismissed vide order dated May 17th, 2012. 

4.      Complainant preferred revision petition before the Hon’ble National Consumer Disputes Redressal Commission, New Delhi against the orders of the District Forum and State Commission. 

5.      By order dated July 20th, 2015 the revision petition was accepted directing this Commission to decide the appeal on merits.  Parties were directed to appear before this Commission today, that is, August 24th, 2015. 

6.      Learned counsel for the respondent has stated that he has no objection in setting aside the orders of the District Forum.

7.      In view of above, the appeal is accepted and the orders dated July 08th, 2011 and March 30th, 2012 are set-aside. The complaint is restored at its original number.

8.      The District Forum is directed to issue notice to both the parties and to dispose of the complaint as expeditiously as possible, preferably within six months from the date of receipt of this order.

9.      Copy of this order be sent to the District Forum.
