Final Order / Judgement

Common Oral Order in six consumer complaints bearing Nos.669 of 2016 To 674 of 2016

Per – Hon’ble Mr. V. P. Utpat, President

In all these consumer complaints, none present for the Complainants even on second call.  Today Complainants failed to appear before this Forum without any sufficient reason.  Perusal of the order-sheet reveals that so was the position even on previous date viz. 05/12/2016.  By an earlier order passed by this Forum in the month of August-2016, Complainants were permitted to take appropriate steps for service of notice to the Opposite Party by substituted service by public citation through paper publication.  However, till today Complainants have not complied with said order and there is no report available on record as regards service of notice to the Opposite Party.  Thus, in these peculiar circumstances, it does appear to this Forum that Complainants have lost their interest in further prosecution of present consumer complaints.  Thus, it is not desirable to prolong these cases.  Hence, consumer complaints stands dismissed for want of prosecution as contemplated under Section-13(2)(c) of the Consumer Protection Act, 1986 read with Rule-4(7) of the Maharashtra Consumer Protection Regulations, 2000.  No order as to costs.

Pronounced on 28th February, 2017
