SRI. P. V. JAYARAJAN: PRESIDENT
This complaint is filed under Sec. 35 of the Consumer Protection Act, 2019 and the matter stood over to this date for consideration. After hearing the matter this Commission passed an order as follows:
This is a complaint filed by the complainant against the opposite parties alleging deficiency in service on the part of the opposite parties. After admitting the complaint notice was issued to the opposite parties to appear before this Commission on 02.02.2024. The 1st opposite party entered appearance and filed written version denying the allegations raised by the complainant. After accepting the notice, the 2nd opposite party failed to appear before this Commission and hence on 22.02.2024 the 2nd opposite party was called absent and set ex-parte. Now the case stands posted to 02.07.2024 for filing proof affidavit of the complainant. Meanwhile the parties to the proceedings filed a compromise memo stating that the matter is settled. In order to consider the compromise memo filed by the parties to the proceedings, this Commission suo moto advanced the case from 02.07.2024 to this date. The compromise memo signed by both parties is accepted and recorded. As per the compromise the opposite party has repaired the product free of cost and the complainant has acknowledged the same. The complainant also endorsed that he is willing to close the case. In view of the settlement arrived at between the parties to the proceedings, we find that this is a fit case to be dismissed as settled.
In the result, the complaint is dismissed as settled. There will be no order as to cost.
A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
