2. Mobile Care (Authorized Service Centre), SCO No.62, First Floor, Swastik Vihar, MDC, Panchkula.
3. M/s Darshita Aashiana Pvt. Limited, (M/s Nahar Logistics Park Pvt. Ltd.), Khewat No.79/80 & 39/59, Khasra No.306, 348/305,48 & 56 through its Authorized Signatory, Near Katana Sahib Gurudwara, Ludhiana (Punjab) through its Authorized Signatory/Directors.

OP No.2 already ex parte vide order dated 02.12.2019.

File put up on an application moved by the Complainant seeking permission to withdraw the present complaint. Ld. Counsel for the OP No.1, on the instructions of the OP No.1, by making a separate statement, stated that the dispute between the parties has been settled as per terms and conditions contained in the undertaking dated 09.07.2021, which is tendered on record as Mark ‘A’. As per undertaking Mark ‘A’, OP No.1 shall pay an amount of Rs.8989/- (coupon) to the Complainant, as full and final settlement of the claim with regard to the product in question as mentioned in the present complaint, within maximum period of 60 days from the date of signing of the said undertaking dated 09.07.2021, subject to the condition that the Complainant shall return the product in question alongwith its accessories to the OP No.1. It is further stated that both the parties have consented to the terms and conditions as mentioned in the undertaking dated 09.07.2021, and after this settlement, they shall not raise any dispute/claim/allegations against each other.
On the other hand, the Complainant, by making a separate statement, stated that she has gone through the statement made by the Ld. Counsel for the OP No. 1 and agrees with the same, hence, she withdraws the present complaint.
Heard. In view of the statement made by both the parties, the present Consumer Complaint is hereby dismissed as withdrawn. It is made clear that both the parties shall be bound by their respective separate statements.
A copy of this order be sent to the parties, free of costs and File be consigned to the record room, after due compliance.
