Today, the Member/Sh.Jaswant Singh Dhillon is on leave. File taken up today, i.e. on 09.12.2023 in the National Lok Adalat on the application filed by Counsel for complainant for recording the statement of parties regarding compromise.

Today, Statement of Sh.Vishal Chaudhary, Adv. Counsel for OP No.1 i.e. Samsung India Electronics has been recorded to the effect that as a good will gesture OP No.1 is ready to settle the case for refund of price of product in question as per Invoice, subject to the complainant will return the old mobile hand set in proper condition at the time of accepting of demand draft of the refund. Time of 45 days may be given for the compliance of the order.

Furhter, statement of complainant in person recorded that he will return the said handset to the complainant on receiving of demand draft of Rs.78,000/- as offer given by OP No.1. As such the present complaint may be dismissed as withdrawn being compromised.

In view of statement suffered by Ld. Counsel for OP No.1 as well as complainant in person and the fact that the good sense has prevailed upon the parties and they have settled the matter amicably. So accordingly, the award is passed with the direction to the OP No.1 to pay the amount of mobile handset as per Invoice i.e. a sum of Rs.78,000/- on receiving the old mobile set in proper working conditions at the time of accepting of demand draft of the refund within a period of 45 days. The present complaint is accordingly disposed of. Copy of the award be supplied to the parties, free of costs, as per rules. File be consigned to the record room.
