Amarjeet            Vs.          Samsung India Electronics.

                        Written statement filed by the opponents. Copy supplied to the opposite counsel.  As per para No.3 of the written statement filed by the opponent No.1, complainant had not complained regarding any defect in the mobile to the authorized service centre of the opponent No.1 and neither there is any such job sheet etc. placed on record by the complainant in this regard. Under the circumstances, to maintain the balance and in order to avoid any sort of prejudice to the parties, this Commission is of the firm view, in case, appropriate directions are given to the opponent to solve the problem, it will suffice the purpose and ends of justice will meet. The complainant will produce the mobile, subject matter of the invoice Ex.C3 within the period of 15 days from today before the opponent No.3 being the authorized service centre of the opponent No.1 and the authorized service centre of the opponent No.1 examine the mobile and keeping in view the terms and conditions of the warranty policy of the manufacturing company will repair the mobile, free of costs. If the terms and conditions of the warranty are not applicable as per the wisdom of the opponent No.3, then it will repair the mobile against cost within the period of 15 days from the date of receipt of mobile from the complainant and thereafter, if the complainant is not satisfied, he will be at liberty to file afresh complaint before the Commission, raising his grievance and in afresh complaint, he will disclose the particulars of this complaint and also attached the copy of this order. File be consigned to the records.
