Opposite party No. 2 exparte.

Sh. Chander Bansal Advocate filed power of attorney on behalf of opposite party No. 1 and made a statement that the opposite party No. 1 is ready to refund the price of the hand set in question as per the invoice amounting Rs. 1,07,380/- to the complainant subject to that the complainant will return the handset in question alongwith accessories in proper condition without any further damage. His statement recorded and taken up on the file. 

On the other hand learned counsel for the complainant made a statement that she has heard the statement of learned counsel for the opposite party No. 1 and agreed with the same and withdraw the present complaint. Her statement also recorded and taken up on the file.

In view of the statements of the parties, present complaint is dismissed as withdrawn. Parties are bound by their undertakings made today before this Commission. However, no order as to costs or compensation. Copy of the order be supplied to the parties free of costs. File be consigned to the records after due compliance.
