CONSUMER COMPLAINT NO. 457  OF  2023

AWARD

1.   Vide his separate statement recorded on 19.01.2024, Sh.Devinder Kumar, Counsel for OP No.1 to 3 has stated that the matter has been settled between the parties and as per settlement, the OP No.1 to 3 shall pay an amount of Rs.25,680/- (80% of the invoice amount of the product) to the complainant within a period of 30 days from 19.01.2024 in full and final settlement of the present matter, subject to return of refrigerator in question alongwith its accessories, if any, by the complainant. Vide his separate statement recorded on 19.01.2024, Sh.Ashwani Sharma, Counsel for Complainant has admitted the aforesaid statement of counsel for OP No.1 to 3 and prayed that the complaint be disposed of in terms of aforesaid settlement in Upbhokta Lok Adalat. It has been further stated by counsel for complainant that he does not press this complaint against OP No.4 & 5 and prayed that the same be dismissed as withdrawn against them.

2.   In view of the statements made by the counsels for the parties and in terms of the settlement, the complaint stands disposed of by passing the following order:-

1. OP No.1 to 3 shall pay an amount of Rs.25,680/- to the complainant within a period of 30 days from 19.01.2024.
2. In case OP No.1 to 3 fails to pay the aforesaid amount within the stipulated period, then OP No.1 to 3 shall be liable to pay the same alongwith interest @ 9% p.a. from the date of filing of present consumer complaint i.e. 21.09.2023 till the payment is made.
3. OP No.1 to 3 shall take back the refrigerator in question alongwith its accessories, if any, from the complainant only after making the payment of aforesaid awarded amount.

3.   The complaint against OP No.4 & 5 is dismissed as withdrawn.

4.   The award is accordingly passed.

5.   Certified copies of this order be sent to the parties free of cost. The file be consigned.
