Learned counsel for opposite party No. 1 made a statement that the opposite party No. 1 without going into the merits of the present complaint and by knowing that the handset in question is physically damaged and is not covered under warranty, and complainant being an Advocate as a goodwill gesture is ready to repair the handset free of costs. 45 days time may kindly be granted to repair the handset in question from the date of receipt of order. His statement recorded and taken up on the file.

Learned counsel for the complainant made a statement that I have heard the statement of the counsel for the opposite party No. 1 and agreed with the same. I will handover the handset to the service centre of opposite party No. 1 within few days against proper receipt. Accordingly I do not want to proceed with the present complaint on behalf of complainant and same may kindly be dismissed as withdrawn. His statement also recorded and taken up on the file.

In view of the statements of the parties, present complaint is dismissed as withdrawn. Parties are bound by their undertakings made today before this Commission. However, no order as to costs or compensation. Copy of the order be supplied to the parties free of costs. File be consigned to the records after due compliance.
