Ld. counsel for the opposite party no.1 has made a following separate statement before the Commission:-

          “Stated that as per the instructions of the company, company is ready to return the amount of Rs.55,000/- i.e. billing amount of the mobile in question to the complainant within a period of 45 days from the date of receiving of copy of statement and order, subject to return the original job sheet regarding the deposit of earlier mobile set in question to the Samsung Service Centre.”

            On the other hand, complainant has suffered a following statement:-

            Stated that I have heard the statement of counsel for the opposite party no.1/Samsung India and agree with the same, so I do not want to pursue with the present complaint further and the same may please be dismissed as withdrawn as per the statement.

          In view of the statement made by complainant as well as ld. counsel for the opposite party no.1, the present complaint stands dismissed as withdrawn. However, both the parties shall be bound by their respective statements. Copy of the order be supplied to the parties free of costs. File be consigned to record room.
