This is a complaint filed under section 35 of Consumer Protection Act 2019 and the matter stood over to this date for consideration.After hearing the matter the commission passed an order as follows:
This is a complaint filed by the complainant against the opposite parties alleging deficiency in service on the part of the opposite parties. After admitting the complaint notice was issued to the opposite parties. 1st opposite party though entered appearance, not filed version within the stipulated time. Notice to the 2nd and 3rd opposite parties served and they have not appeared and hence on 05/11/2021 the 2nd and 3rd opposite parties were called absent and set ex parte. As the complainant was continuously absent, this Commission issued a notice to the complainant to appear before this Commission today to further proceed with this complaint. The said notice issued to the complainant was returned with endorsement ‘unclaimed’. The complainant also not filed affidavit. From the above circumstances we find that the complainant is not interested to further proceed with this complaint.
In the result the complaint is dismissed for default. There will be no order as to cost.
A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
