SRI.P.V.JAYARAJAN : PRESIDENT
1. This complaint is filed under section 35 of Consumer Protection Act 2019 and stood over to this date for consideration and this Commission passed the following order.
2. This is a complaint filed by the complainant against the opposite parties alleging deficiency in service on the part of the opposite parties. After admitting the complaint notice was issued to the opposite parties. The first opposite party entered appearance and filed written version denying the allegations raised by the complainant. After accepting the notice the second opposite party failed to appear before this commission and hence on 25/02/2022 the second opposite party was called absent and set exparte. Subsequent to that several postings were given to the complainant for filing proof affidavit. As the complainant was continuously absent and not filed proof affidavit, this commission issued a notice to the complainant to appear before this commission to further proceed with this complaint. The said notice issued to the complainant was returned with endorsement “addressee not known’’. In the above circumstances, we find that the complainant is not willing to further proceed with this complaint.
In the result, the complaint is dismissed for default. There will be no order as to costs.
A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
