Written version filed by the opposite party No. 1. Learned counsel for the opposite party No. 1 made a statement that we are ready to refund the price of the handset in question of Rs. 1,07,970/- to the complainant subject to return the handset in question to the company without any damage in proper condition at the time of receiving the DD/cheque of the amount. We will issue the DD/cheque within 45 days from the date of receiving the copy of the order. His statement recorded and taken up on the file. 

On the other hand learned counsel for the complainant made a statement that I have heard and agreed with the statement of the counsel for the opposite party No. 1 and I want to withdraw the present complaint. Her statement recorded and taken up on the file. 

In view of the statements of the learned counsel for the opposite party No. 1 and the complainant, present complaint is dismissed as withdrawn. However, the parties are bound by their undertakings made today before this Commission. No order as to costs or compensation. Copy of the order be supplied to the parties free of costs. File be consigned to the records after due compliance.
